The right to be granted a patent for a given invention lies with the first person to file a fully-supported patent application. Rushing to the patent office, however, does not necessarily lead to the best outcomes in patenting. Finding that perfect time to file a patent is a collaborative process between the inventor and the Weill Cornell Medicine Center for Technology Licensing (CTL), discovering a time that is not too early or too late. In this session, we will discuss real-life examples of practical considerations in invention disclosure timing, including enablement, written description and the hazards of prior art in publishing scientific findings before patenting.
